Acceptance and scope
These Terms govern access to and use of missmateriales.com, Miss Materiales Studio, the digital resource catalog, and memberships offered by PLATAFORMAS MEDIX SAS (together, the “Services”). By creating an account, purchasing a resource, or subscribing, you accept these Terms and our Privacy Notice.
You must be at least 18 years old and legally able to enter into a contract. If you use the Services for a school or organization, you represent that you are authorized to bind it regarding your use.
Account and access
You must provide accurate information, keep it current, and protect your credentials. You are responsible for activity under your account and must notify us if you suspect unauthorized access.
Your account is personal. It may not be sold, assigned, or shared in a way that allows multiple people to bypass access or payment limits. We may request reasonable verification to protect the account and associated purchases.
Digital materials and license
Purchases and downloads grant a limited, non-exclusive, non-transferable, revocable license for the buyer to use the materials in their own teaching practice and classrooms.
You may print, display, and adapt resources for your classroom. You may not resell them, redistribute files, publish them in repositories or social networks, remove authorship notices, incorporate them into commercial products, or enable third-party downloads. All rights not expressly granted are reserved.
Studio, teacher content, and student data
You retain any rights you hold in observations, plans, and other content you enter. You authorize us to host, process, and transform that content only to operate, secure, and improve the Services as described in the Privacy Notice.
If you enter student information, you represent that you have the required authorization and legal basis. Use only a first name and essential educational information. Do not enter surnames, CURP identifiers, addresses, contact details, medical records, diagnoses, or other unnecessary identifiers or sensitive data.
You are responsible for the accuracy and professional use of your content. Miss Materiales does not replace official school record systems and must not be used as a student’s sole record.
Artificial intelligence features
AI features generate drafts and suggestions from the information provided. They may contain errors, omissions, or unsuitable output. The teacher must review, edit, and approve each result before using or sharing it.
Outputs are not medical, psychological, educational, or legal diagnoses and are not automated decisions about students. Do not use them to discriminate, sanction, or make high-impact decisions without professional review and sufficient context.
Prices, payments, and delivery
Before purchase, we display the product or plan, currency, billing frequency, and applicable amount. Taxes and promotions appear when relevant. Stripe processes payments; we do not store your full card number.
Materials are delivered digitally in your account library or through access sent to the purchase email. Check the email address and language selection before paying. If a price or product is clearly erroneous, we may cancel the transaction and refund any charge.
Memberships, renewal, and cancellation
Memberships renew automatically according to the period, price, and billing date disclosed during checkout until canceled. By subscribing, you authorize the corresponding recurring charges.
You may cancel at any time through the billing portal in your account. Cancellation stops future renewals, and access continues through the paid period. We do not issue prorated refunds unless applicable law requires otherwise. A scheduled billing-cycle change begins after the current period ends.
If payment fails, we may suspend paid features after the grace period shown in your account. Canceling does not delete your account or separately purchased materials.
Digital material cancellations and refunds
Because digital content is delivered immediately, material sales are final once access or download is enabled. This rule does not limit any non-waivable rights provided by law.
Contact us if a file is defective, incomplete, or different from what you purchased; a charge is duplicated or unauthorized; or access could not be delivered. We will review each case and, as appropriate, restore access, replace the file, or issue a refund.
Acceptable use and suspension
You may not compromise security, automate bulk downloads, access other accounts or data, introduce malicious code, interfere with the Services, use them unlawfully, or infringe third-party rights.
We may limit or suspend access when reasonably necessary to protect users, students, rights holders, or the platform; investigate fraud or abuse; comply with an authority; or address a breach. When possible, we will explain the reason and allow you to correct it.
Intellectual property
Miss Materiales, its characters, trademarks, designs, software, templates, text, and resources belong to PLATAFORMAS MEDIX SAS or its licensors and are protected by applicable law. These Terms do not transfer ownership.
If you believe content infringes your rights, send the material description, location, contact information, and evidence of ownership to our email.
Availability and liability
We work to keep the Services available and secure, but maintenance, provider outages, or feature changes may occur. We do not guarantee uninterrupted availability or that every output will fit every educational need.
Nothing in these Terms excludes liability that cannot legally be limited or reduces consumer rights. To the maximum extent permitted, we are not liable for indirect harm resulting from use contrary to these Terms or decisions made without professional review.
Changes to the Services or Terms
We may update the Services and these Terms for legal, operational, or security reasons. We will publish the current version and update date. If a material change affects an active membership, we will provide reasonable notice before it takes effect.
If you do not accept a material change, you may stop using the Services and cancel future renewals through the billing portal.
Governing law, consumers, and contact
These Terms are governed by Mexican law. We will first try to resolve disputes through direct contact. Without affecting non-waivable consumer rights or jurisdiction, the parties may submit to the competent authorities or courts in Monterrey, Nuevo León.
